1. Agreement to Terms
By accessing or using Hangjegyzet ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.
Governing Law: These Terms are governed by the laws of Hungary and the European Union.
2. Service Description
Hangjegyzet provides automated audio transcription services. Features include:
- Audio file uploads (MP3, WAV, M4A, etc.)
- Automated speech-to-text transcription
- Transcript editing and export (TXT, SRT formats)
- Subscription-based usage limits
- Cloud storage for audio files and transcripts
Service Availability: We aim for 99% uptime but do not guarantee uninterrupted access. The Service is provided "as-is" without warranty of accuracy or completeness.
3. User Accounts
3.1 Registration
To use the Service, you must:
- Be at least 16 years old
- Provide accurate registration information (email address)
- Verify your email address
- Create a secure password
- Comply with these Terms
Account Responsibility
You are responsible for maintaining confidentiality of your account credentials and all activities under your account. Notify us immediately of unauthorized access.
3.2 Account Termination
By You:
- You may delete your account at any time via Settings → Privacy
- Deletion is final after 30-day grace period
- No refunds for unused subscription time (unless required by law)
By Us:
- We may suspend or terminate your account if you violate these Terms
- We will provide notice unless immediate action is required (e.g., illegal activity)
4. Subscriptions and Payments
4.1 Plans
Free Tier
- 30 minutes of transcription per month
- Limited file storage
- No payment required
Premium Plan
- 300 minutes of transcription per month
- 1,990 HUF/month
Professional Plan
- 1,500 minutes of transcription per month
- 7,990 HUF/month
4.2 Billing
- Payment Processor: Payments processed by Stripe, Inc.
- Billing Cycle: Monthly subscriptions bill on the same day each month
- Currency: Hungarian Forint (HUF). Prices include VAT where applicable.
- Automatic Renewal: Subscriptions auto-renew unless canceled before renewal date
4.3 Refunds
Refunds are provided at our discretion. For full details, see our Refund Policy.
EU Right of Withdrawal (14 days)
Under EU Consumer Rights Directive, you may withdraw within 14 days of purchase. Refund pro-rated if Service partially used.
4.4 Price Changes
We may change prices with 30 days' advance notice. Changes apply to renewals, not current billing periods. If you do not accept the price change, cancel your subscription before renewal.
4.5 Taxes
Prices include Hungarian VAT (ÁFA) where applicable. EU businesses may provide valid VAT ID for reverse charge. You are responsible for any additional taxes in your jurisdiction.
5. User Content
5.1 Your Rights
You retain all ownership rights to audio files and content you upload ("User Content").
License to Us
By uploading, you grant us a limited license to store files, process them for transcription, and display transcripts to you. This license is non-exclusive, worldwide, royalty-free, for the sole purpose of providing the Service. License ends when you delete files or close your account.
5.2 Your Responsibilities
You represent and warrant that:
- You own or have rights to all User Content
- User Content does not violate third-party rights (copyright, privacy, etc.)
- User Content does not violate laws or regulations
- User Content does not contain malware or harmful code
Prohibited Content
- Child sexual abuse material (CSAM)
- Content promoting terrorism or violence
- Illegal content (hate speech, harassment, threats)
- Malware, viruses, or harmful code
- Content violating third-party intellectual property
Consequences: We may delete prohibited content and terminate your account without notice.
5.3 Confidentiality
Your Content is Private. We do not access, view, or share your files except:
- As required to provide the Service (automated processing)
- To comply with legal obligations (court orders, subpoenas)
- With your explicit permission
6. Intellectual Property
6.1 Our Rights
The Service, including software, design, logos, and trademarks, is owned by us and protected by copyright, trademark, and other intellectual property laws.
Restrictions
You may not:
- Copy, modify, or distribute our software
- Reverse engineer or decompile the Service
- Use our trademarks without permission
- Frame or mirror the Service on other websites
7. Acceptable Use
You agree NOT to:
- Violate laws or regulations
- Infringe third-party rights
- Upload prohibited content (see Section 5.2)
- Abuse the Service (scraping, DDoS, hacking attempts)
- Resell or redistribute the Service
- Use the Service for spam or mass unsolicited communications
- Circumvent usage limits or payment systems
- Impersonate others or provide false information
8. Third-Party Services
The Service integrates with third-party providers:
- Stripe (Payments): Subject to Stripe's Terms of Service
- Cloudflare (Storage): Subject to Cloudflare's Terms of Service
- Soniox (Transcription): Subject to Soniox's Terms of Service
We do not endorse or control third-party services. Review their terms and privacy policies.
9. Disclaimers and Limitations of Liability
9.1 Disclaimer of Warranties
"AS-IS" Service: The Service is provided "as-is" and "as available" without warranties of any kind, including fitness for a particular purpose, merchantability, non-infringement, accuracy of transcriptions, or uninterrupted operation.
You use the Service at your own risk.
9.2 Transcription Accuracy
Automated transcription is not 100% accurate. Factors affecting accuracy include:
- Audio quality (background noise, echo, distortion)
- Speaker accents and speech patterns
- Technical jargon or specialized vocabulary
- Multiple speakers or overlapping speech
Not Suitable For:
- Medical diagnoses or advice
- Legal proceedings (without human verification)
- Safety-critical applications
- Financial or contractual decisions
9.3 Limitation of Liability
To the maximum extent permitted by law, we are NOT liable for:
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, data, or business opportunities
- Damages exceeding amount paid to us in the 12 months prior to the claim
Exceptions: This limitation does not apply to liability that cannot be excluded under Hungarian law, personal injury or death caused by our negligence, or fraud.
10. Dispute Resolution
10.1 Governing Law
These Terms are governed by the laws of Hungary and the European Union.
10.2 Informal Resolution
Before filing a lawsuit, please contact us at legal@hangjegyzet.hu to resolve disputes informally.
10.3 EU Online Dispute Resolution
EU consumers can use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/
11. Data Protection
Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to data processing as described in the Privacy Policy.
GDPR Rights: EU residents have rights under GDPR (access, erasure, portability, etc.). See Privacy Policy for details.
12. Changes to Terms
We may update these Terms at any time. Material changes will be notified via email or prominent notice on our website. Changes effective 30 days after notice.
Your Acceptance: Continued use after effective date constitutes acceptance. If you do not agree, terminate your account before effective date.
